Legal Requirements and Age Verification
You must be 21 years of age or older to access and use this site, or order or receive alcoholic beverages from Alpha Omega Collective. By using this website and placing any order for alcoholic beverages, you represent and warrant that you are at least 21 years of age.
By federal law, receipt of shipments containing alcoholic beverages requires the signature of a sober adult (a person 21 years of age or older who is not intoxicated). We encourage using a business address for shipments if possible. We cannot ship to P.O. boxes because deliveries require a signature. Wines purchased from Alpha Omega Collective are not for resale and are for personal consumption only.
Account Security
If you create an account on this website, you are responsible for maintaining the confidentiality of your account credentials and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized access to or use of your account or any other breach of security. You should use particular caution when accessing your account from a public or shared device.
Alpha Omega Collective reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion if you violate any provision of these Terms of Use.
Wine Club Memberships and Auto-Renewal
If you enroll in an Alpha Omega Collective wine club or any other subscription or automatic renewal program, the following terms apply in addition to any separate wine club agreement:
Automatic Renewal Disclosure. Your wine club membership will automatically renew at the end of each membership period unless you cancel before the renewal date. You will be charged the then-current membership price plus applicable taxes and shipping at each renewal. The frequency of shipments and charges will be disclosed at the time of enrollment.
Your Consent. By enrolling in a wine club, you provide your affirmative consent to the automatic renewal terms, including recurring charges to the payment method you provide.
Cancellation Rights. You may cancel your wine club membership at any time by completing the cancellation form on our website, by emailing us at info@aowinery.com or info@tolosawinery.com, or by calling us at (707) 963-9999 or 888-605-0188. If you enrolled online, you may cancel online through the cancellation form available on your account page. Cancellation will be effective for the next scheduled shipment, provided the cancellation is received before processing of that shipment has begun.
Renewal Notices. We will provide you with a reminder before each annual renewal, including the renewal terms, charges, and instructions for cancellation.
Material Changes. If we make a material change to the terms of your wine club membership, we will provide you with clear and conspicuous notice of the change and information regarding how to cancel. For fee changes, we will provide notice no less than 7 days and no more than 30 days before the fee change takes effect.
Enrollment Acknowledgment. Upon enrollment in a wine club or automatic renewal program, we will send you an acknowledgment in a retainable format (such as email) that includes the automatic renewal terms, the cancellation policy, and instructions for how to cancel.
Credit Card Charges
Orders are by credit card only. We accept Visa, MasterCard, Discover, and American Express. All prices are listed in U.S. dollars. You agree to pay all charges incurred in connection with your purchases at the prices in effect when the charges are incurred, including all applicable taxes and shipping fees.
Errors and Omissions
While we make every effort to ensure the accuracy of product listings on this website, prices, bottle sizes, vintages, or quantities may occasionally be incorrect. In the event of an error, Alpha Omega Collective shall not be bound by the incorrect information. If an error is identified before an order is processed, we will attempt to contact you before any charges are made so you can decide whether to proceed. We reserve the right not to fulfill any order that we determine was placed based on erroneous information. If you discover an error in an order you have placed, please contact us immediately before the order is processed.
Shipping and Delivery
Alpha Omega Collective ships wine directly to consumers in compliance with applicable state and federal law. Due to state alcohol shipping regulations, we are unable to ship to all states. Orders placed for delivery to states where direct-to-consumer wine shipping is prohibited or where Alpha Omega Collective does not hold the required permits will be cancelled and refunded. It is your responsibility to ensure that someone 21 years of age or older is available to sign for delivery. Shipment times are estimates and are not guaranteed.
Return Policy
Alpha Omega Collective stands behind our products and takes pride in meeting our customers’ needs. Returns and credits can only be processed if the wine or merchandise is returned to our warehouse in the same condition as when it left and is of current vintage. Shipping costs are not refundable. For cash returns, a receipt showing cash purchase must be provided.
